Nghiên cứu sử dụng tiếp cận liên ngành nhằm hóa giải xung đột pháp lí giữa quyền sở hữu trí tuệ (SHTT) cá nhân và quyền văn hóa tập thể của cộng đồng dân tộc thiểu số trong bối cảnh chuyển đổi số. Trên cơ sở nhận diện các khoảng trống pháp lí trong Luật SHTT 2025 và Luật Di sản văn hóa 2024 về tính liên thế hệ của di sản, tác giả đề xuất khung bảo hộ tích hợp: (1) Xác lập vị thế pháp lí tập thể và chủ quyền dữ liệu di sản; (2) Kĩ thuật hóa luật tục thông qua chuẩn hóa siêu dữ liệu và nhãn văn hóa (TK Labels); (3) Quản trị dữ liệu số dựa trên công nghệ Blockchain và Hợp đồng thông minh; (4) Kiến tạo hệ sinh thái đạo đức số và trách nhiệm của các nền tảng công nghệ. Những giải pháp này không chỉ xác lập vững chắc quyền tự quyết số (IDSov) và hiện thực hóa bước chuyển từ bảo tồn thụ động sang quản trị tích cực nhằm bảo vệ trọn vẹn “dòng chảy sống” của di sản, mà còn kiến tạo nền tảng bảo tồn căn tính văn hóa cộng đồng trước áp lực trích xuất dữ liệu và thương mại hóa công nghệ hiện nay.
